For Mexican spirits producers, the European Union represents a booming market with a thirst for premium agave spirits. However, the road to Paris, Madrid, or Berlin is paved with red tape. A label that works perfectly for other regions, could likely be rejected in the EU.

To get your product on European shelves, you must satisfy three layers of law simultaneously: your domestic Mexican regulations (CRT/CRM), harmonized EU standards, and specific national requirements (like France’s pregnancy warnings or Ireland’s upcoming cancer labels).

Here is your essential guide to navigating the EU labelling labyrinth.

1. The Foundation: Mexican Mandatory Requirements (CRT & CRM)

Before you worry about Brussels, your label must first pass in Guadalajara or Oaxaca. EU protection for “Tequila” and “Mezcal” as Geographical Indications (GIs) is legally tied to your compliance with Mexican standards.

For Tequila (NOM-006-SCFI-2012):

  • The Word “Tequila”: Must be prominent.
  • Category & Class: e.g., “100% de Agave” and “Reposado” or other classes.
  • “Hecho en México”: Mandatory statement of origin.
  • NOM Number: The official NOM logo and 4-digit Authorized Producer number.
  • Lot Number: Crucial for traceability.

For Mezcal (NOM-070-SCFI-2016):

  • Category: “Mezcal”, “Mezcal Artesanal”, or “Mezcal Ancestral”.
  • Agave Species: You must list the scientific or common name of the agave(s) used.
  • “Denominación de Origen Protegida”: This specific phrase is mandatory.
  • State of Origin: e.g., “Oaxaca”.
  • Hologram: The certified CRM/COMERCAM hologram stamp.

2. Essential EU Label Requirements (The “Harmonized” Rules)

Once the bottle leaves Mexico, it falls under Regulation (EU) 1169/2011. These rules apply across all 27 member countries.

The “Field of Vision” Rule

Three specific pieces of information must appear in the same field of vision (usually the front label) so the consumer can see them simultaneously without turning the bottle:

  1. The Legal Name: e.g., “Tequila” or “Mezcal” (The GI serves as the legal name).
  2. Net Quantity: Must be in metric units (700ml is the standard, 750ml is not allowed in the EU, learn more).
  3. Alcohol Strength: Format is strict. It must be “X % vol” (e.g., 40% vol).

Other Mandatory Information (Back Label):

  • EU Importer Address: You cannot just list your Mexican distillery address. You must list the name and physical address of the EU-based Food Business Operator (FBO) or importer. This is the entity legally responsible for the product in Europe.
  • Lot Number: e.g., L-2024-01.
  • Allergens: If your product contains allergens, they must be declared.
    • Note: Pure agave spirits are usually allergen-free, but if you use barrels that held nuts, or additives, watch out.
    • Sulfites: Although rarely used in strong spirits, if your product contains >10mg/liter of SO2, you must state “Contains sulphites” (in the language of the destination country).

3. The “e” Mark: What it is and why you might want it

You will often see a lowercase ‘e’ (℮) next to the volume (e.g., 700ml ℮). This is voluntary but highly recommended.

  • What it means: It certifies that your bottling plant meets EU “Average Quantity” requirements. It guarantees that the average volume of the batch is correct and that no single bottle is significantly under-filled.
  • The Benefit: It acts as a “metrological passport.” If your bottle has the ‘℮’ mark, it can move across borders within the EU (e.g., from Spain to Germany) without being subject to further weight/volume checks.
  • Requirements:
    • Minimum height: 3mm.
    • Must be in the same field of vision as the Net Quantity.

4. Health Warnings & The “Patchwork” Problem

This is where things get tricky. While the EU has shared food laws, individual countries are allowed to enforce their own public health rules.

  • France (Pregnancy Warning): It is mandatory to include a warning against drinking during pregnancy. While text is allowed, almost everyone uses the pictogram (silhouette of a pregnant woman crossed out).
    • Compliance Tip: Ensure it is high contrast and at least 10mm in diameter to avoid issues, though the law technically only requires it to be “conspicuous.”
  • Ireland (The New Standard – May 2026): Ireland is introducing the world’s strictest alcohol labelling laws. From May 2026, labels destined for Ireland must include:
    • A red-text warning: “THERE IS A DIRECT LINK BETWEEN ALCOHOL AND FATAL CANCERS”.
    • A warning about liver disease.
    • The grams of alcohol and calorie content per container.
  • Recycling Logos: Spain, Italy, and France now require specific environmental labelling (like the “Info-Tri” pictogram in France or material codes in Italy) to tell consumers how to recycle the bottle (Glass bin vs. Plastic bin).

Do not try to use your U.S. label in Europe. It will fail.
